Terms of Service
The terms that apply when you book or use our services.
1. About These Terms
These Terms of Service govern the IT support, repair and custom software services we provide and your use of this website. By requesting a quote, booking an appointment or otherwise engaging our services you agree to be bound by these terms. This is a draft prepared for review. It has not yet been checked by a solicitor and should not be relied on as legal advice.
2. Quotes and Pricing
Quotes are estimates based on the information available at the time and may change if the scope of work changes once we begin. Where we operate on a no-fix-no-fee basis for a repair you will not be charged for the repair attempt itself if the fault cannot be resolved. This does not cover diagnostic time already disclosed to you or parts already ordered with your agreement.
3. Bookings and Appointments
Appointments are scheduled through the booking process on this website or by direct arrangement. Please provide accurate contact details and a clear description of the issue so we can prepare appropriately. If you need to cancel or reschedule, please let us know as early as possible so the time can be offered to another customer.
4. Payment Terms
Invoices are due by the date stated on the invoice. Reminders are sent before and after the due date as a courtesy. Payment remains your responsibility regardless of whether a reminder is received. We reserve the right to charge a reasonable rate for overdue accounts and to decline further work until an outstanding invoice is settled.
5. Warranty on Repairs
Repairs carried out by us are covered by a warranty against the same fault recurring, for the period stated on your invoice or quote. This warranty covers our workmanship and does not extend to unrelated faults; further damage caused by continued use of a device with a known issue; or issues arising from your own subsequent changes to the device. Parts supplied by third-party manufacturers are covered by the manufacturer's own warranty terms where applicable. It also does not cover data loss, which is addressed separately in section 6.
6. Repair and Data Risks
Repair, diagnostic and support work on hardware and software carries inherent risk. We want you to understand this before engaging our services.
Opening a device; testing components; or reinstalling software can reveal or worsen a pre-existing fault that was not caused by our work. This risk is higher on older or already failing hardware such as an ageing hard drive or a worn connector. Software repairs, driver updates and operating system reinstalls can also occasionally conflict with other software already on the device or require existing programs to be reinstalled afterward.
Data loss is a real possibility during any repair or support session, whether from hardware failure; software corruption; or a necessary reinstall. Where data recovery is requested we will make reasonable efforts using standard tools and techniques. Recovery is never guaranteed, and some data may be permanently unrecoverable regardless of the method used. For this reason we strongly recommend backing up your data before any device is left with us or accessed remotely, and section 7 sets out your responsibility to do so.
7. Your Responsibilities
Before any device is left with us or accessed remotely you are responsible for backing up your own data. This is especially important given the risks described in section 6. We take reasonable care, but we are not responsible for data loss during a repair or support session except to the extent caused by our own negligence. You are responsible for ensuring you are legally entitled to have us access; repair; or service the device or system in question. You are also responsible for providing accurate information about the fault and any relevant account credentials needed to carry out the work.
8. Remote Access and Data Security
Where remote support is provided, access to your device is only used for the purpose of the agreed work and only for as long as necessary to complete it. We do not access files or data beyond what is reasonably necessary to diagnose or resolve the issue you have engaged us for. Any software installed or changed during remote support is limited to what the agreed work requires, and we will let you know beforehand if a change carries a meaningful risk to your existing setup.
9. Custom Software Work
For custom software or development work, ownership of the final delivered work product transfers to you once paid in full unless otherwise agreed in writing. Until full payment is received, all work remains our property. Any third-party libraries; frameworks; or services used as part of the work remain subject to their own separate licence terms.
10. Limitation of Liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee; right; or remedy that cannot lawfully be excluded under the Australian Consumer Law. To the extent permitted by law our liability for any claim arising from our services is limited to the amount you paid for the specific service giving rise to the claim. We are not liable for indirect or consequential loss. This includes loss of data; profits; or business, consistent with the risks described in section 6. This exclusion does not apply where the loss arises from our own negligence.
11. Cancellation and Refunds
If a service cannot be completed for reasons outside your control we will discuss a fair outcome with you. This may include a partial or full refund depending on the work already carried out. Deposits or payments made for parts already ordered on your behalf are generally non-refundable once the order has been placed with the supplier.
12. Changes to These Terms
We may update these Terms of Service from time to time to reflect changes in our services or legal requirements. The current version will always be available on this page, and the terms that applied at the time you engaged us will continue to govern that specific engagement.
13. Governing Law
These terms are governed by the laws of New South Wales, Australia. Any dispute arising from them is subject to the exclusive jurisdiction of the courts of that state.
